What are human rights? What makes a particular human rights claim ‘genuine’ or ‘valid’? These are difficult questions with which current philosophical literature on human rights is concerned. They are also the same kind of questions that legal philosophers asked about Law throughout the 20th century. Drawing from the similarities between the two fields, I attempt to do with the concept of human rights something similar to what Ronald Dworkin accomplished with that of Law in Law’s Empire. First, I offer (...) a critique of the two dominant perspectives on human rights—the Orthodox and Political views—that is similar in character to Dworkin’s Semantic Sting objection to Legal Positivism. Second, I sketch an alternative, Dworkinian-inspired framework that seeks to develop the notion of human rights as an interpretive concept. According to this framework, different accounts of human rights are to be understood as expressing different interpretations of the point (or purpose) of human rights practice. (shrink)

Como área interdisciplinar, as Ciências Cognitivas começam a se desenvolver em meados da década de 1950 a partir de uma concepção compartilhada sobre a mente, hoje chamada de cognitivista. Esses pesquisadores concebiam a mente com uma natureza representacional que opera por meio de computações simbólicas. Atualmente, há uma multiplicidade de abordagens e teorias sobre a mente. Nesse espectro de posições, há desde abordagens tradicionais, que concebem a mente como representacional, até abordagens bastante radicais, que negam qualquer natureza representacional para a (...) mente. Após introduzir este tema, apresentamos as críticas de William Ramsey à representação enquanto definidora das Ciências Cognitivas ou, em outros termos, à representação enquanto critério de demarcação do cognitivo. Desenvolveremos uma hipótese interpretativa para a crítica de Ramsey mobilizando o conceito de estratégia de pesquisa, de Hugh Lacey. Apresentaremos a distinção de Lacey entre adoção de uma estratégia e aceitação de uma teoria, discutindo a suposta independência avaliativa entre estratégia e teoria. Finalizaremos com a defesa de um pluralismo de estratégias nas Ciências Cognitivas. Diferente de concepções que buscam reduzir prematuramente as Ciências Cognitivas a uma única estratégia, o pluralismo que defendemos equilibra a eficiência na resolução de problemas com outros valores considerados importantes, como a abrangência empírica e a neutralidade no sentido de inclusividade e equitatividade de valores. No atual momento das ciências cognitivas, o pluralismo de estratégias constitui o caminho mais promissor. (shrink)

n the first part of the paper I will present Pritchard’s approach to Wittgenstein’s notion of hinge commitments, which is essential to his solution to the closure-based sceptical arguments. And, in the second par of the paper, I will raise some concerns that I have regarding Pritchard’s non-belief reading of the hinge commitments. In the third and final part, I make some concluding remarks regarding Pritchard’s overall strategy to solve the closure-based sceptical paradox.

In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. Metaphysical anti-realism is a large and heterogeneous group of views that do not share a common thesis but only share a certain family resemblance. Views as different as mathematical nominalism—the view that numbers do not exist—, ontological relativism—the view that what exists depends on a perspective—, and modal conventionalism—-the view that modal facts are conventional—all are versions of metaphysical anti-realism. As the latter two examples suggest, relativist ideas play a starring role in many versions of metaphysical anti-realism. But what does (...) it mean for the existence of something to “depend on” a perspective, or for a modal fact to “depend on” a convention? We can distinguish between various dependence relations, giving rise to an array of drastically different forms of metaphysical anti-realism. This article offers a guided tour. I develop a systematic distinction between various forms of metaphysical anti-realism with a focus on the role of relativist ideas in this landscape. (shrink)

We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

The aim of this paper is to investigate the relationship between information and abductive reasoning in the context of problem-solving, focusing on non-human animals. Two questions guide our investigation: What is the relation between information and abductive reasoning in the context of human and non-human animals? Do non-human animals perform discovery based on inferential processes such as abductive reasoning? In order to answer these questions, we discuss the semiotic concept of information in relation to the concept of abductive reasoning and, (...) more specifically, to the notion of manipulative abduction proposed by Magnani. Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

A large network of alchemical agents spread from the tiny, land-locked duchy of Saxe- Gotha-Altenburg outward across Europe. At its centre, Duke Friedrich I meticulously documented his interactions with many alchemical personalities during the 1670s and 1680s. The story of one such personality illustrates the changing meanings of distant alchemical knowledge both to the inner circle of courtly alchemists and to a larger alchemical republic. Born near Gotha, Johann Otto von Hellwig built his pan-European career on a youthful stay on (...) Java. To some, this indicated his access to exotic naturalia which might be imported to a centre of collection, such as Gotha. For others, Hellwig could access a wisdom hidden abroad since ancient Egypt, which should be disseminated among widely dispersed adepts. These viewpoints indicate different functions for distant knowledge, as well as differing desired trajectories for this knowledge. (shrink)

O povo Kaingang é o mais populoso do Sul do Brasil e está entre os mais numerosos povos indígenas do país. Neste trabalho faz-se uma relação entre as informações encontradas na literatura e a atualidade na Terra Indígena Kaingang em relação ao conhecimento que possuem sobre o uso de plantas para a cura de doenças e como interpretam a ação da erva no organismo. Para isto, realizou-se uma pesquisa de campo em uma Terra Indígena Kaingang no Paraná, cujo entrevistas forneceram (...) confirmações históricas em relação aos etnoconhecimentos da etnia, da evolução dos aspectos químicos e das atitudes perante a química e os remédios de origem farmacêutica e natural. Therapeutic strategies capable of inducing and enhancing prosthesis embodiment are a key point for better adaptation to and acceptance of prosthetic limbs. In this study, we developed a training protocol using an EMG-based human-machine interface that was applied in the preprosthetic rehabilitation phase of people with amputation. This is a case series with the objective of evaluating the induction and enhancement of the embodiment of a virtual prosthesis. Six men and a woman with unilateral transfemoral traumatic amputation without previous use (...) of prostheses participated in the study. Participants performed a training protocol with the EMG-based HMI, composed of six sessions held twice a week, each lasting 30 mins. This system consisted of myoelectric control of the movements of a virtual prosthesis immersed in a 3D virtual environment. Additionally, vibrotactile stimuli were provided on the participant’s back corresponding to the movements performed. Embodiment was investigated from the following set of measurements: skin conductance response, crossmodal congruency effect, ability to control the virtual prosthesis, and reports before and after the training. The increase in the skin conductance response in conditions where the virtual prosthesis was threatened, recalibration of the peripersonal space perception identified by the crossmodal congruency effect, ability to control the virtual prosthesis, and participant reports consistently showed the induction and enhancement of virtual prosthesis embodiment. Therefore, this protocol using EMG-based HMI was shown to be a viable option to achieve and enhance the embodiment of a virtual prosthetic limb. (shrink)

A relevância adquirida pelo pensamento de Michel Foucault no Brasil contemporâneo é circunstância bem conhecida. A despeito disso, poucos têm se dedicado a investigar suas cinco visitas a nosso país, datadas de 1965, 1973, 1974, 1975 e 1976. Sendo assim, a autora desenvolveu a pesquisa "Michel Foucault no Brasil: presença, efeitos e ressonâncias", cujos objetivos incluem o estabelecimento de uma "audiografia" da presença do Foucault-corpo no Brasil - análise do modo como ele aqui ocupou os espaços de fala -, bem (...) como de uma "geo-epistemologia" - busca das condições geopolíticas de produção do saber - e de uma "cronobibliografia" das ideias de Foucault entre nós - exame analítico-crítico das temporalidades associadas à primazia conferida a determinados procedimentos, categorias, problemáticas e conceitos pelos intelectuais e militantes brasileiros. Para tanto, foram utilizados documentos escritos e fonográficos relativos às visitas, artigos, coletâneas e livros brasileiros voltados à discussão das perspectivas de Foucault, e narrativas orais tanto dos que com ele conviveram nas passagens por São Paulo, Rio de Janeiro, Belo Horizonte, Salvador, Recife e Belém como daqueles que, atualmente, exibem efeitos e ressonâncias de seu pensamento nos âmbitos acadêmico, profissional e político. Os ensaios que compõem este livro já haviam sido publicados aqui e ali, e foram apenas ligeiramente modificados - evitando repetições excessivas, mas mantendo alguma reiteração, para que possam ser apreciados em qualquer ordem, ou mesmo selecionados conforme os interesses específicos dos leitores. O presente artigo discute o conceito de cidadania e sua relação com as questões educacionais, sobretudo, as relacionadas ao campo da Educação de Jovens e Adultos. Constitui-se como resultado de pesquisa intitulada “Cidadania e EJA: concepções e desafios que marcam a escola pública brasileira” no âmbito do Núcleo de Estudos sobre Trabalho e Educação da Faculdade de Educação da Universidade Federal de Juiz de Fora. O texto destaca como o conceito de cidadania se desenvolveu historicamente, buscando seus fundamentos ideológicos e (...) políticos no liberalismo, correlacionando-o com a perspectiva de Estado e de educação defendida por essa corrente. Demonstra que a concepção burguesa de cidadania se desdobra sobre o campo educacional, expondo sua relação com a acumulação flexível de cunho capitalista. A concepção marxista de educação rompe com essa unilateralidade, apresentando a universalização do trabalho e da educação como expressão do humano, da pluralidade cultural e das concepções de mundo que marcam as experiências coletivas e individuais. Nesse modelo, as exigências educacionais para jovens e adultos são direcionadas a tornar esses sujeitos capazes de enfrentar, mesmo que minimamente, o mercado globalizado e assumir projetos de vida pautados no mérito das ações econômicas – por meio de uma educação ao longo da vida, com o objetivo de se manterem na condição de empregáveis. Portanto, o texto que se segue visa contribuir com as reflexões de educadores que almejam a construção de uma educação socialista e democrática. Esse processo, que se estabelece nos âmbitos coletivo e social – possível apenas com o rompimento e a superação do modelo social de capital e com a instauração de uma sociedade com novas formas de sentir, pensar e agir no mundo. AimTo evaluate the cognitive functioning of subjects practicing trance mediumship in Brazil.MethodThe study was based on the measurement of cognitive functions of 19 spirits mediums through neuropsychological tests such as the Brief Cognitive Screening Battery, the Verbal Fluency Test, the digit span test, the cube test, the five digit test and an evaluation of mental health through scales such as the Beck Depression Inventory, the Self-Report Questionnaire, and the Trauma History Questionnaire. The sample included the participation of spirit mediums divided (...) into two groups. The more experienced group with 11 subjects had more than 10 years of mediumistic practice, while the other less experienced group with 8 subjects had 1–5 years of experience. The inclusion criteria were psychophonic mediums with regular trance practices for at least one year. The data collected were analyzed using the SPSS statistical package.ResultsRegarding performance on the BCSB and digit span test, all subjects reached scores at the median or higher in comparison to standardized scores of Brazilians. Scores of 90% on the cube test and 42% on the FAS were reached in comparison to median or higher values, versus the median of standardized scores among Brazilians. On the FDT, we found statistical significance in the choice stage, with higher performance of subjects whose initial age of trance recognition occurred before 21 years old. On the BDI scale, no participant met the criteria for major depression. The SRQ showed an incidence of common mental disorders in 21% of the sample, which was more prevalent in the LEG.ConclusionThe cognitive functioning of subjects who practice trance mediumship in Brazil is associated with cognitive health. Executive dysfunction may be a tendency in LEG. However, an incidence of common mental disorders in the LEG was observed. Executive processing was higher in the subgroup with early practices of recognizing the phenomenon. (shrink)

According to the doctrine of Super-Humeanism, the world’s mosaic consists only of permanent matter points and changing spatial relations, while all the other entities and features figuring in scientific theories are nomological parameters, whose role is merely to build the best law system. In this paper, I develop an argument against Super-Humeanism by pointing out that it is vulnerable to and does not have the resources to solve the well-known problem of immanent comparisons. Firstly, I show that it cannot endorse (...) a fundamentalist solution à la Lewis, since its two pillars—a minimalist ontology and a best system account of lawhood—would generate, together, a tedious problem of internal coherence. Secondly, I consider anti-fundamentalist strategies, proposed within Humeanism, and find them inapplicable to the Super-Humean doctrine. The concern is that, since it is impossible to choose the best law system within Super-Humeanism, this doctrine may be charged with incoherence. (shrink)

Delusion is one of the most intriguing psychopathological phenomena and its conceptualization remains the subject of genuine debate. Claims that it is ill-defined, however, are typically grounded on essentialist expectations that a given definition should capture the core of every instance acknowledged as delusion in the clinical setting.

In this paper, I discuss whether the results of loop quantum gravity (LQG) constitute a fatal blow to Humeanism. There is at least a prima facie reason for believing so: while Humeanism regards spatiotemporal relations as fundamental, LQG describes the fundamental layer of our reality in terms of spin networks, which are not in spacetime. However, the question should be tackled more carefully. After explaining the importance of the debate on the tenability of Humeanism in light of LQG, and having (...) presented the Humean doctrine, I review two cases which present serious threats to Humeanism, one concerning the fundamentality of vectorial quantities and the other concerning quantum entanglement. In particular, I recall the strategies that are usually employed in these two cases in order to save Humeanism: in the first case, the strategy consists in amending the characterization of the Humean mosaic; in the second case, it consists in adopting a realist or nomological interpretation of the wave function. These solutions will turn out to be helpful in my discussion of LQG where, after describing LQG, I show that Humeans might save their doctrine either by endorsing a realist interpretation of spin networks, or by giving them a nomological status and, at the same time, by revisiting the characterization of the Humean mosaic. Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

Taking into account the debate about the continuity or discontinuity in Heb 1-12 and Heb 13, with the implication of whether the hortatory material in chapter 13 is consistent with chapters 1-12 or it is a list of miscellaneous exhortations instead, this article seeks to discern connections between the concept of marriage in 13:4 with the ideas stated in 12:28–13:6. This endeavor is informed by a reading of 12:28-13:6 made in three steps. First, 12:28-29 is read as a transition for (...) the hortatory material in chapter 13. Second, 13:1-6 is traced as a conceptual structure for the understanding of marriage in 13:4. Third, the article identifies connections of the exhortation about marriage in 13:4 with ideas developed in 12:28-29 and 13:1-6. (shrink)

Replicability is usually considered to be one of the cornerstones of science; however, the growing recognition of nonreplicable experiments and studies in scientific journals—a phenomenon that has been called ‘replicability crisis’—has spurred a debate on the meaning, function, and significance of replicability in science. Amid this discussion, it has become clear that replicability is not a monolithic concept; what is still controversial is exactly how the distinction between different kinds of replicability should be laid out terminologically and conceptually, and to (...) what extent it bears on the more general debate on the centrality of replicability in science. This paper’s goals are to clarify the different uses of the terms related to replicability and, more importantly, to conceptually specify the kinds of replicability and their respective epistemic functions. This papers’ goal is to present a survey of the contemporary discussions regarding truthmakers. The emphasis will be on the characterization of the truthmaking relation and on the problems involved in universal propositions and negations.

The aim of this Swedish study was to develop the concept of moral sensitivity in health care practice. This process began with an overview of relevant theories and perspectives on ethics with a focus on moral sensitivity and related concepts, in order to generate a theoretical framework. The second step was to construct a questionnaire based on this framework by generating a list of items from the theoretical framework. Nine items were finally selected as most appropriate and consistent with the (...) research team’s understanding of the concept of moral sensitivity. The items were worded as assumptions related to patient care. The questionnaire was distributed to two groups of health care personnel on two separate occasions and a total of 278 completed questionnaires were returned. A factor analysis identified three factors: sense of moral burden, moral strength and moral responsibility. These seem to be conceptually interrelated yet indicate that moral sensitivity may involve more dimensions than simply a cognitive capacity, particularly, feelings, sentiments, moral knowledge and skills. The possibility of neurotechnological interference with our brain and mind raises questions about the moral rights that would protect against the (mis)use of these technologies. One such moral right that has received recent attention is the right to mental integrity. Though the metaphysical boundaries of the mind are a matter of live debate, most defences of this moral right seem to assume an internalist (brain-based) view of the mind. In this article, we will examine what an extended account of the (...) mind might imply for the right to mental integrity and the protection it provides against neurotechnologies. We argue that, on an extended account of the mind, the scope of the right to mental integrity would expand significantly, implying that neurotechnologies would no longer pose a uniquely serious threat to the right. In addition, some neurotechnologies may even be protected by the right to mental integrity, as the technologies would becomepart ofthe mind. We conclude that adopting an extended account of the mind has significant implications for the right to mental integrity in terms of its protective scope and capacity to protect against neurotechnologies, demonstrating that metaphysical assumptions about the mind play an important role in determining the moral protection provided by the right. Theories of graded causation attract growing attention in the philosophical debate on causation. An important field of application is the controversial relationship between causation and moral responsibility. However, it is still unclear how exactly the notion of graded causation should be understood in the context of moral responsibility. One question is whether we should endorse a proportionality principle, according to which the degree of an agent’s moral responsibility is proportionate to their degree of causal contribution. A second question is whether (...) a theory of graded causation should measure closeness to necessity or closeness to sufficiency. In this paper, we argue that we should indeed endorse a proportionality principle and that this principle supports a notion of graded causation relying on closeness to sufficiency rather than closeness to necessity. Furthermore, we argue that this insight helps to provide a plausible analysis of the so-called ‘Moral Difference Puzzle’ recently described by Bernstein. (shrink)

Although Chinese law imposes informed consent for medical treatments, the Chinese understanding of this requirement is very different from the European one, mostly due to the influence of Confucianism. Chinese doctors and relatives are primarily interested in protecting the patient, even from the truth; thus, patients are commonly uninformed of their medical conditions, often at the family’s request. The family plays an important role in health care decisions, even substituting their decisions for the patient’s. Accordingly, instead of personal informed consent, (...) what actually exists is ‘family informed consent’. From a Western perspective, these features of Chinese law and Chinese culture might seem strange, contradicting our understanding of doctor-patient relationship and even the very essence of self-determination and fundamental rights. However, we cannot forget the huge influence of cultural factors in these domains, and that ‘Western’ informed consent is grounded on the individualistic nature of Western culture. This article will underline the differences between the Western and the Chinese perspectives, clarifying how each of them must be understood in its own cultural environment. But, while still respecting Chinese particularities, this paper advocates that China adopt patient individual informed consent because this is the only solution compatible with human dignity and human rights. One dimension of cognitive success concerns getting it right: having many true beliefs and no false ones. Another dimension of cognitive success concerns using the right concepts. For example, using a concept of a person that systematically excludes people of certain demographics from its extension is a sort of cognitive deficiency. This view, if correct, tasks inquirers with critically examining the concepts they are using and perhaps replacing those concepts with new and better ones. This task is often referred to (...) as “conceptual engineering”. However, so far it is unclear what exactly happens in cases of conceptual engineering. How does language change when we engineer a concept? This article offers an answer. I propose a view on which, when speakers assess the truth of propositions, they often rely on assumptions with regard to what is required for their truth. For example, when speakers assess whether unborn fetuses are people, they rely on assumptions with regard to what is required to be a person. Based on this idea, I develop a model of conceptual engineering according to which speakers “engineer concepts” when they change how they assess the truth of propositions.
